AGREEMENT FOR USE
Dunlora Community Association, Incorporated (hereafter DCA), as agent for Dunlora Swim and Tennis Club, LLC (hereafter DS&TC), grants ______________________ (hereafter resident) access and use of the swim clubhouse and/or the swimming area on _______________from__________ to _____________, for the purpose of __________________________. This Agreement for Use is subject to the following conditions:
1. If held during normal club hours, the guests of the resident will respect the rights of other Dunlora residents to the normal and unhampered use of the facilities, including but not limited to, the exercise room, changing facilities, bathrooms, play yard, kitchen, and pool area.
2. If held outside normal club hours, the resident will pay DS&TC the actual costs of lifeguards (if applicable), and other personnel as required. This payment will be negotiated through the manager of the swimming pool, who must be notified about the event at least one week in advance in order to ensure the availability of the required lifeguard(s).
3. The resident is solely and entirely responsible for setting up the area to be used, as well as cleanup and restoration of the space to its original condition. This includes repair or replacement of any damaged items. If additional cleanup or restoration is required, the resident will be billed for the actual cost.
4. The sponsoring resident may provide alcoholic beverages. However, if alcoholic beverages are provided and consumed on the premises, the resident assumes all responsibility for enforcement of applicable laws (relevant to underage drinking, driving under the influence and the like). The resident also agrees to respect the fact that DS&TC is a family oriented club and agrees to keep the visibility of alcohol at a practical minimum. DCA, DS&TC, their employees, and other representatives of either organization are not agents for the resident.
5. No glass containers are allowed in the swimming pool area.
6. Catering personnel may set up tables/serving areas inside the pool perimeter (as designated by fencing). Preparation of food must take place outside the pool perimeter.
7. Adults are not allowed in either the play yard or the “baby pool” area unless accompanying children (in the case of the play yard, children are youth 12 years and under – and in the case of the “baby pool,” children are youth 5 years and under.
8. The resident is solely and entirely responsible for the behavior of his or her guests. In the event of misconduct or failure to abide by this agreement by any party associated with it, any agent of DCA or DS&TC may evict individual(s) or close the area. Agents include lifeguards, the pool manager and general manager, any member of the Board of Dunlora Community Association, and any officer of the law, whether on duty or not.
9. All other applicable policies regarding the pool and clubhouse area apply.
10. The general manager of the Dunlora Community Association must be notified within 72 hours of any change in the event.

The resident agrees to hold harmless from any damages both DCA and DS&TC for the duration of the event noted above. The resident accepts all incidental liability, except that which is the result of negligence, during this event.
